Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to drowning from
rolling over into
the water while driving a tractor near a water canal:
On or about 11/16/2009, an employee engaged in crop planting drowned when
the tractor fell
into a water canal.
Among other methods of abatement, a feasible and acceptable method to
correct this hazard is
for: The employer to implement a policy prohibiting moving agricultural
equipment such as
tractors to travel near the road's edge embankment adjacent to the water
canals.
