Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm. Employees were exposed to the hazards
associated with dust explosion,
deflagration, or other fire hazards:
a.On or about November 20, 2009, dust collection systems located inside
the production area were not
designed to prevent or minimize damage that would occur in the event of a
dust explosion. The
Donaldson Torit TD-486 dust collector, providing dust control for the
Chilsonator, the Donaldson
Torit TD-573 dust collector providing dust control for the ribbon blender,
and the Torit Model 84
mobile dust collector did not have explosion protection systems.
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method
to
correct this hazard includes following NFPA 654, Standard for the
Prevention of Fire and Dust
Explosions from the Manufacturing, Processing, and Handling of Combustible
Particulate Solids (2006
Edition). The design of explosion protection for equipment shall include,
but is not limited to: a)
relocating dust collectors outside of the building; b)  equipping dust
collectors with deflagration
venting vented to the outside and designed to withstand the effects of
deflagration; c) deflagration
pressure containment in accordance with NFPA 69 Standard on Explosion
Prevention Systems; d)
installing deflagration suppression systems in accordance with NFPA 69
Standard on Explosion
Prevention Systems.
b.On or about November 20, 2009, dust collection system components located
inside the production area
were not conductive. The Pulva Mill had been equipped with non-metallic
ducts leading to the dust
collector, the Chilsonator had been equipped with non-metallic ducts
leading to the dust collector, and
the ribbon blender had been equipped with a non-metallic duct leading to
the dust collector.
ABATEMENT NOTE: Among other methods, one feasible and acceptable method to
correct this
hazard includes following NFPA 654, Standard for the Prevention of Fire
and Dust Explosions from
the Manufacturing, Processing, and Handling of Combustible Particulate
Solids (2006 Edition),
including, but not limited to ensuring all air material separator system
components are conductive to
minimize the build up of static electricity.
c.On or about November 20, 2009, flexible intermediate bulk containers
(FIBC) containing Anox 20, a
combustible dust, were being dispensed into the Chilsonator and were not
electrically grounded or
bonded exposing employees to the hazard of fire or explosion.
ABATEMENT NOTE: Among other methods, one feasible and acceptable method to
correct this
hazard includes following NFPA 654, standard for the Prevention of Fire
and Dust Explosions from
the Manufacturing, Processing, and Handling of Combustible Particulate
Solids (2006 Edition),
including, but not limited to grounding and bonding FIBC containing
combustible dusts during
dispensing operations to minimize the build-up of static electricity.
d.On or about November 20, 2009, equipment was not maintained and operated
in a manner that
minimized the escape of dust in that combustible dust had accumulated over
1/8 inch on the top of the
Donaldson Torit TD-486 dust collector and up to 3 1/2 inches at the bottom
of the Chilsonator as a
result of seal leaks.
ABATEMENT NOTE: Among other methods, one feasible and acceptable method to
correct this
hazard includes following NFPA 654, standard for the Prevention of Fire
and Dust Explosions from
the Manufacturing, Processing, and Handling of Combustible Particulate
Solids (2006 Edition),
including, but not limited to maintaining and operating equipment in a
manner that minimizes the
escape of dust.
