Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck-by falling portions
of the hoisted load
because of a defective latch on the lifting hook of the 10 ton Konecranes
model
XL404N30BDA414BOES.
Among other methods, one feasible and acceptable abatement method to
correct the
hazard would be to repair or replacement the latch before continuing the
use of the hook
in accordance with ASME B30.10 1999, paragraph 10-1.2.3 Maintenance.
