Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Tripping Hazard Reference: 10 OSH 1926.16(a) In no case shall the prime contractor be relived of overall responsibility for the compliance with the requirements of this part for all work to be performed under the contract. LPC & D Inc. was the prime contractor and Bonn Construction Corp was subcontractor that had exposed employees to the hazards at the material wagon of the Jesus T. Pinero Remodelation Project, Canovanas PR. LPC & D Inc. as a general contractor failed to exercise his authority in order to enforce their safety and health program at the entire project. As a result of the lack of enforcement, it was observed that a subcontractor's (Bonn Construction Corp) employees accessed the wagon through a ramp made of plywood with crossed 2"x4" wood poles. The higher point of the ramp was 51 inches above the ground. The distance along the ramp between the foot and the top support was 64 inches and the width of the ramp was 52 inches. It was documented that the employees walked into the wagon to retrieve and store their tools and construction materials. Carrying these objects limited employees's visibility to the floor. The two by four (2"x4") wood poles that had a height of one and a half inches (1 1/2"), nailed to the ramp's surface represented a tripping hazard. Feasible abatement method to correct this hazard may include, but not are limited to: Construct a stairway with risers height and tread depth uniformly LPC & D Inc. era el contratista primario y Bonn Construction Corp era un subconstratista que tenia empleados expuestos a riesgos en el vagon de materiales del Proyecto de Remodelacion del Residencial Jesus T. Pinero, Canovanas PR.
