Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of crushing injuries associated with
the tipping over of
a steel racking system were not anchored to the floor with anchor bolts
capable of resisting
the forces caused by the horizontal and vertical loads on the rack :
(a) Bright of America shipping and receiving: On May 25, 2010 and times
prior
to, the employer operated forklifts in the warehouse lading material on
steel
racking systems which were not anchored to the floor to resist forces
caused
by the horizontal and vertical loads, potentially being struck by moving
equipment.
ABATEMENT NOTE: Among other methods, feasible and acceptable
abatement methods to correct this hazard are:
1. To follow MH 16.1: 2008 ANSI-RMI specification of the Design, Testing
and Utilization of Industrial Steel Storage Racks 1.4.7 Column Base Plates
and
Anchors the bottom of all columns shall be furnished with column base
plates,
as specified in the Section 7.2. All rack columns shall be anchored to the
floor
with anchor bolts capable of resisting the forces caused by the horizontal
and
vertical loads on the rack.
2. To follow the manufacturers  for anchoring column base plates to resist
the
forces caused by the horizontal and vertical loads on the rack(s).
