Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by vehicular traffic:
a)  Employees were exposed to being struck by moving vehicles while
working along the road
without wearing high-visibility reflective vest.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
would be to follow Chapter 6D Pedestrian and Worker Safety as delineated
in the Manual on
Uniform Traffic Control Devices, 2003 edition (Section 6D.03B Worker
Safety Apparel) and
use high visibility apparel such as vests that meet ANSI/ISEA 107-2004
Standard for High
Visibility Safety Apparel and Headgear for risk exposure Class 2 or 3.
No abatement certification or documentation is required for this item.
