Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer failed to ensure automotive lifts in the shop were properly maintained and operated, as follows: a.The employer did not have operator training documentation for employees using a Challenger automotive lift (m/n CL100, s/n 060400000024302), as required by ANSI/ALI ALOIM-2000 paragraph 4.3: The owner or employer shall appropriately document operator training by completing the operator training log found in the appendix to this standard. b.The employer did not stop using the Challenger automotive lift after all 4 lift leg contact pads were worn off. ANSI/ALI ALOIM-2000 paragraph 4.4.4(7) required the lift operator to inspect on a daily basis damage or excessive wear on any of the lift contact point which engage the vehicle during lifting, whether they engage the tires, frame, body or axles. ANSI/ALI ALOIM-2000 paragraph 4.5 required: If any of the conditions described above are observed, the operator shall stop using the lift. Employees were exposed to serious broken bone injuries from vehicle slippage at lift leg contact points. One feasible means of abatement would be to follow the requirements of ANSI/ALI ALOIM- 2000 in order to ensure reliability and allow the continued safe operation of the lift.
