employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to metal dust explosion, deflagration or other fire hazards:
(a)The Sunspan dust collector associated with Wheelabrator cleaning
station number
2 was located inside the building, had no deflagration vents and recycled
air back
into the building.
(b)The Wheelabrator dust collector associated with Wheelabrator cleaning
stations
number 3 and 4 was located inside the building, had no deflagration vents
and
recycled air back into the building.
Feasible abatement methods include complying with NFPA 484 Standard for
Combustible
Metals, such as but not limited to: (1) moving the Sunspan and
Wheelabrator
dust collectors to
a safe outdoor location; (2) installing deflagration vents on the Sunspan
and Wheelabrator dust
collectors; (3) installing deflagration isolation systems such as abort
gates on ductwork; and (4)
discharging air exhausted from the Sunspan and Wheelabrator dust
collectors to a safe outdoor
location.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
