Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health
Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees, in that:  employees were standing on midrails and sitting on
toprails of 2 scissor lifts
exposed to a fall of 12 feet to a concrete floor.
(a)Jobsite at Keystone Drive, Hattiesburg, MS - On or about October 28,
2009
employees were observed standing on the midrails and sitting on the top
rails of 2 scissor
lifts. The employees were exposed to a fall hazard of 12 feet.
Among other methods. one feasible and acceptable method to correct hazard
is to comply with
ANSI/SIA A92.6-1999, Self-Propelled Elevating Work Platforms, Chapter
7.10(9) states that
"personnel shall maintain a firm footing on the platform floor while
working thereon. Climbing
by occupants on the midrail or toprail of the aerial platform is
prohibited."
