General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from elevated work stations: The employer does not ensure that fall protection is used while employees work inside advertising signs at a height over 20 ft. This violation last occurred on or about September 16, 2009, at an advertising sign where employees were exposed to the hazard of falling to the ground below. Among other methods, one (1) feasible and acceptable method to correct this hazard is: (1) provide a mounting cable horizontally located across the length of the top of the sign which would, when used as a tie off point for the lanyards attached to the employees safety harness, limit the distance of a possible fall to six feet or less;(2) provide safety harnesses and lanyards which are appropriate for the condtions of use to all affected employees. Pursuant to 29 C.F.R. 1903.19, within ten (10) days, the employer must submit documentation describing the actions it is taking to establish, implement, and enforce the use of a fall protection method.ion
