Section 5(a)(1) The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing, or were likely to cause death or serious physical harm to employees in that employees were exposed to potential chemical and fire hazards: a. On or about August 12, 2010, and at times prior, employees were required to use an unrated garden hose for the transfer of jet fuel from storage tanks to a refueling tanker truck. In addition, the deadman switch used to start and stop the flow of jet fuel was inoperable; employees were required to bypass the normal controls and use a push-button start/stop system for jet fuel transfer. Among other methods, one feasible and acceptable abatement method to correct these hazards is to refer to National Fire Protection Association (NFPA) 407-17 through 407-18, which sets specifications for aircraft fuel hoses and NFPA 407-40, which requires and specifies the use of deadman controls to start and stop the transfer of jet fuel. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
