Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards associated with being crushed or struck by
falling objects:
Old and New Warehouses:
On April 5, 2010, the Nifco storage rack system used to store pallets of
food
products
including canned and bottled goods, was not installed so as to prevent
damage or collapse
of the racks.   Deficiencies included, but were not limited to:
a) Bottom portions of the racks were damaged in areas such as New Warehouse
Aisle C and D and Old Warehouse Aisle E and F.
b) Lack of anchoring of columns in areas such as Old Warehouse.
c) Permanent plaques placed in the environs of the existing racks
designating load
sizes and other important information were not affixed to racks.
Among other methods, one feasible abatement method to correct this hazard
is to:
a) Provide column protectors and/or steel clad impact panels.
b) Provide anchors that are capable of resisting sheer forces caused by
horizontal
and vertical loads.
c) Users should consult with the manufacturer to supply the applicable
plaques or
obtain a predetermination by a qualified person and the rack loaded in
accordance
with their requirements, plaques would not be necessary.ts,
