North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to a struck or crushed by hazard:
a)job site - where employees operated a Toyota L32 Forklift (Model
02-5FD25, Serial Number
70496) equipped with a roll over protection system (ROPS)without a
seatbelt.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to install
a manufacturer approved seat belt for employees to use while operating the
forklift.
