North Carolina General Statutes 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that are causing or are likely to cause death or serious injury or serious physical harm to his employees in that employees were exposed to a struck-by injury: a)Facility, the three bay shop area, where employees were exposed to a struck-by injury due to the employer suspending a Central Machinery 3-ton hoist (Model 2211), which vertically lifts 400 to 600-pound riding lawn mowers, from a rigid frame purlin and the maximum load capacity was not obtained from either a structural engineer or the buildings manufacturer. b)Facility, the three bay shop area, where employees were exposed to a struck-by injury due to the employer suspending a 1-ton hoist, which vertically lifts 400 to 600-pound riding lawn mowers, from two rigid frame purlins and the maximum load capacities were not obtained from either a structural engineer or the buildings manufacturer. c)Facility, the three bay shop area, where employees were exposed to a struck-by injury due to the employer suspending a 2-ton hoist, which vertically lifts 400 to 600-pound riding lawn mowers, from a rigid frame clearspan and the maximum load capacity was not obtained from either a structural engineer or the buildings manufacturer. Abatement Notes: Obtain the rated load capacity of the rigid frame clearspans and purlins used to suspend the hoists (chain blocks) from either a structural engineer or the buildings manufacturer. Mark the load rating on the affected rigid frame clearspans and purlins so that the load rating is clearly visible from the shop floor. If the load ratings are unobtainable, discontinue suspending chain blocks from the rigid frame clearspans and purlins.

Abatement Notes: Discontinue suspending the hoists (chain blocks) from the binding/tie down chains. Obtain chains designed by the manufacturer for overhead lifting such as Grade 80 high-grade alloy steel or better and ensure the chains are appropriately marked or tagged with the name of the manufacturer, the grade of chain, the nominal chain size, the rated load for the chain, and the angle upon which the rating is based. For the entire hoisting system (including overhead lifting chains and chain blocks), establish and implement an inspection and maintenance program based on the manufacturers recommendations for each component in the system and in accordance with OSHA Standard 29 CFR 1910.184.
