OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards from not utilizing an operator restraint system on powered industrial trucks (forklifts): a.) Landpro Equipment LLC, 7852 Pennsylvania 66, Fairmount City, PA 16224: Shop Area- on or about 03/17/2026 and at times prior thereto; The employer did not ensure that employees operating powered industrial trucks used in the movement of materials used operator restraint devices . Employees operated the John Deere JD480 diesel forklift serial #148030T without using the seatbelt. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

Landpro Equipment LLC, 7852 Pennsylvania 66, Fairmount City, PA 16224: Shop Area- on or about 03/17/2026 and at times prior thereto; employees operate the John Deere JD480 diesel forklift serial #148030T in the yard Area. Employees are exposed to hazards that include, but is not limited to, the forklift was leaking hydraulic fluid from the mast cylinder. b.) Landpro Equipment LLC, 7852 Pennsylvania 66, Fairmount City, PA 16224: Shop Area- on or about 03/17/2026 and at times prior thereto; employees operate the John Deere JD480 diesel forklift serial #148030T in the yard Area. Employees are exposed to hazards that include, but is not limited to, the seat cushion for the powered industrial truck was damaged. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. Landpro Equipment LLC, 7852 Pennsylvania 66, Fairmount City, PA 16224: Shop Area- on or about 03/17/2026 and at times prior thereto; employees operate the John Deere JD480 diesel forklift serial #148030T in the yard Area. Daily inspections/examinations of the forklift identified hydraulic fluid leaking from the mast cylinder, but the forklift was not taken out of service for repairs. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
