Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards and crushing injuries. (a) Ocean Department - On or about October 7, 2009, warehouse employees were exposed to the hazard of falling from heights of up to 9 feet while placing placards onto ocean cargo from an elevating platform that was not adequately secured to the forklift. A pin lock used to secure the forks to the platform was missing. A safety chain used to secure the platform to the mast and to secure the gate system were damaged. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide a means by which to secure elevating platforms to the lifting carriage or forks of lift trucks in accordance with American National Standard Institute (ANSI), B56.1-2005 Safety Standard for Low and High Lift Trucks, Section 4.17. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
