Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
On or about November 30, 2009, and times prior thereto, employees were
required to
operate a press brake without a functioning guard to cover the foot pedal
used to activate
the machine.  One feasible means of abatement, among others, is to provide
a guard or
cover for the foot pedal that meets the requirements of ANSI (American
National
Standards Institute) B11.3-1973 section 4.2.4.2.4.
