Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of:being seriously injured or killed in a rollover truck accident while operating a dump truck on ground that was not flat and level. Location - River Path Drive, Framingham, MA: On or about 11/13/09 an employee was exposed to a rollover hazard from a dump truck being operated on ground that was not level. One feasible means of abatement to correct this hazard is to provide a level area for dumping.On or about 11/13/09 the employee was operating a dump truck on ground that was not level.
