Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that employees were exposed to the hazard of being struck by vehicles
within a highway
construction zone:
a)Lee county road 72 in the Auburn, AL area; On or about February 8, 2010
employees were exposed to being struck by construction vehicle traffic
while
working within the designated highway work zone. The employer did not
establish a pre-planned traffic pattern for construction traffic and did
not
provide a guide/spotter for the dump trucks in order to ensure the safety
of the
employees working and walking in the construction zone (ref: American
National Standards Institute (ANSI) A10.17 - 2006, Safe Operating Practices
for Hot Mix Asphalt Construction). A feasible and acceptable abatement
method to correct this hazard is to utilize a spotter or "guide" to back
the
dump trucks into position and establish a pre-planned traffic pattern for
construction traffic inside the work zone. The construction traffic plan
shall
include training to all employees that enter, travel within, and exit the
construction work zone.
