General-duty citation text

Nevada Revised Statute 618.375(1):  Duties of employers.  The employer
failed to furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to his employees:
At the Seafood City Supermarket storage room, the employer did not ensure
that the portable
stepladders being used in the stock room were inspected and in a
serviceable condition in
accordance with ANSI A14.5-2000:
a) An employee was using an 8 foot portable stepladder that was damaged.
The employee
was using the ladder to access store room stock shelves approximately 7
feet 8 inches
above the ground. The employee was using the stepladder as a straight
ladder by not
opening it up fully and leaning it against the shelves.
b) The stepladder was not periodically inspected and the damaged ladder
was not
removed from service (ANSI A14.5-2000; 9.4.1 inspection and ANSI
A14.5-2000;
9.4.2
damaged ladders).
c) The stepladder was not being used the way it was designed by ensuring
that the
stepladder was fully opened, with spreaders locked and all feet contacting
a firm level
support surface (ANSI A14.5-2000; 9.3.13.2).
One feasible means of abatement would be to follow the requirements of the
ANSI A14.5-2000
and implement a periodic inspection of the ladders and remove damaged
ladders from service
as well as using stepladders the way they are intended to be used.
