employer did furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees

a)On or about 02/15/2011 at 188 Victory Boulevard Building #3: Employees
were
allowed to work in excess of 15' above ground level from a job-made
platform that
was sitting on the forks of a JLG 944E-42 Rough Terrain Forklift Truck.
The basket/platform was:
1) Not approved.
2) Missing guardrail system/fall protection.
3) Not secured to the forks of the JLG 944E-42.
In addition, the employee working on the platform was not wearing a full
body harness with
shock absorbing lanyard. No fall protection was provided at 15' from the
ground below.
ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD,
AMONG OTHER MEANS, IS TO FOLLOW THE GUIDANCE SET FORTH IN THE
LULL/SKY TRAK/JLG OPERATOR AND SAFETY MANUAL, WHICH PROHIBITS
THE USE OF A NON-APPROVED HOME MADE WORK PLATFORM.
