P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard(s) of being struck-by vehicular
traffic:
a)Along Rice Creek Road, on or about August 26, 2010 an employee who was
wearing a tan shirt was working while in the sub-division street removing
debris
with a gas powered blower, exposed to vehicular traffic.
ABATEMENT CERTIFICATION IS REQUIRED.
One feasible and acceptable means of abatement is to ensure that all
employees wear reflective
vests or other high visibility clothing while exposed to vehicular
traffic.r
