P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by descending personnel basket and boom: A) By storage racks, on or about February 17, 2011, the personnel basket of the aerial lift was raised into the air approximately 12 feet and left in that position when it was not in use or occupied, exposing employees to a hazard of being struck by the aerial lift basket/ boom coming down. ABATEMENT CERTIFICATION IS NOT REQUIRED.TION
