P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard(s) of: crushing, struck-by, ejection,
and tip-over hazards.
a)Throughout job site, on or about and at times prior to July 13, 2011,
employees
worked from an unapproved elevated work platform 16 feet by 3 feet,
supported
by a Skytrack rough terrain forklift, which exposed the employees crushing,
struck-by, ejection, and tip-over hazards up to about 35 feet.
b)Throughout job site, on or about and at times prior to July 13, 2011,
employees
worked from an unapproved elevated work platform 8 feet by 4 feet by 44
inches
high, supported by a Skytrack rough terrain forklift, which exposed
employees
to crushing, struck-by, ejection, and tip-over hazards up to about 14 feet.
ABATEMENT CERTIFICATION IS NOT REQUIRED.
Among other methods, one feasible and acceptable method to correct this
fall hazard is:
Ensure employer consult with the manufacturer's operating manual and the
ANSI B56.6,
which states: To be approved the fork-mounted personnel work platforms
must comply
with the following design requirements before the platform is used:
1.The platform floor must be slip resistant and not located more than 8
in. (200
mm) above the normal load supporting surface of the fork.
2.The platform floor dimensions shall not exceed:
a.Two times the load center distance as identified on the load chart for
the
attachment being used.
b.The platform shall not be wider than the width of the telehandler
(excluding outriggers) plus 10" (250 mm) on each side.
c.Minimum space for each platform occupant shall not be less than 18" (450
mm) in either direction.
3.A 4" (100 mm) minimum high toe plate must surround the perimeter of the
platform but may be omitted at the access opening.
4.Work platform occupants must be protected from pinch points or moving
parts.
5.The following information must be on the personnel work platform:
a.Maximum work load including personnel and equipment.
b.Weight of the empty platform.6.Provide a means to securely mount and
attach the platform to:
a.Only be centered side to side on the attachment and retained against the
vertical face of the forks or carriage.
b.Prevent the platform from inadvertent pivoting.
7.The platform must be equipped with a guard rail meeting the following
criteria:
a.A nominal height to the platform floor of 42" (1066 mm) around the
perimeter
of the platform and include a midrail.
b.The guardrail shall be capable of withstanding a concentrated horizontal
force of
200 lb (890 N) applied at the point of least resistance without permanent
deformation.
8.The platform must be equipped with at least one lanyard anchorage point
for each
occupant and the lanyard anchorage points must be capable of withstanding
three
consecutive drop tests to simulate a 250 lb (113 kg) person falling 6 feet
(1800
mm) without allowing the test weight to fall free to the ground. A
deceleration
device may be included.
9.All load supporting structural elements of the work platform shall have a
structural safety factor of not less than 2 to 1 based on the minimum yield
strength of materials used.
Ensure employer consult with operator's safety manual and the specific
load chart
designated for the specific piece of equipment and attachments to
determine proper load
capacity.
