P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard(s) of:
a)On or about September 11, 2011, at the residential land-clearing
construction
jobsite, the employer failed to provide a workplace that was free from
recognized
hazards that were likely to cause death or serious physical harm to
employee by
lifting the employee via a front-loader/backhoe bucket to elevated heights
to trim
trees, exposing the employee to a 20-ft. fall which caused broken bones and
neurological injury.
One feasible and acceptable means of abatement includes, but is not
limited to following
the AEM Safety Manual for Operating and Maintenance Personnel, pages 9, 20
and 21,
which never permits riders, and forbids using a bucket for a work platform
or personnel
carrier, or to utilize another acceptable alternative means of personnel
lifts.
ABATEMENT CERTIFICATION AND DOCUMENTATION IS REQUIRED.
