Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer
does not
furnish to each of their employees employment and a place of employment
which are free
from the recognized hazards of being struck by moving vehicles which are
causing or likely
to cause death or serious physical harm to employees:
This violation was discovered on or about April 5, 2011 when at least two
(2) employees
were exposed to being struck by moving vehicles while cleaning the four
(4) acre truck
parking lot.
Among other methods, feasible means of abatement include but are not
limited to:
(1) Barricading, demarcating where employees are working;
(2) Using spotters to watch for vehicle traffic nearing employees and warn
the vehicle
operator and exposed employees; and/or
(3) Posting warning signs to make motorists aware of employees working in
the
parking
area; and provide employees with high visibility apparel to make them more
visible to
vehicle operators.
Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the
abatement date, the
employer must submit documentation describing the actions it  is taking to
establish,
communicate and implement written procedures to ensure that employees are
protected from
struck by hazards from vehicles.
