Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a fall hazard from an approximate height of 14 feet and 8 inches working from an unsecured and an unsafe elevated platform that was used with a forklift. On or about 09/22/10 the employees were exposed to a fall hazard at approximately 14 feet when the employer used an unsecured and an unsafe pallet as a working platform to elevate personnel with the forklift in order to access the roof structure. A feasible and useful method to correct the hazard - A feasible way to correct and prevent this hazard from occurring again is to provide the employees with a safe means of access to the roof of the building and /or approved equipment for the forklift with a platform hat meets all of the requirements of the ASME/ANSI B56.1-1988 Safety Standard for Low Lift trucks, paragraphs 4.17.1 (a-f). In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
