Section 5(A)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or were likely
to cause death or
serious physical harm to employees in that employees were exposed to:
a) On or about 12/17/2010 on a job site located on 2101 Village Blvd, West
Palm Beach an
employee was exposed to a fall hazard as he worked from a portable ladder
performing
landscaping work at a height of approximately 12 feet
b) On or about 12/17/2010 on a job site located on 2101 Village Blvd, West
Palm Beach, an
employee was exposed to a fall hazard as he worked from a portable ladder
performing
landscaping work at a height of approximately 6 feet
Among other methods of abatement, one feasible and acceptable method to
correct the hazard
is to prohibit employees from standing on the last step of a portable
ladder as they performed
their work.
