Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: crushing hazards by riding in the bucket of a moving
wheeled loader, also
referred to as a MTL25 Mustang "skid steer".
On or about December 15, 2010, an employee was riding in the bucket of a
MTL25 Mustang
skid steer.  The employee was exposed to a crushing hazard in the event he
were to fall out of
the bucket.
Among other methods, one feasible and acceptable abate method to correct
this hazard is to train
and require employees to operate wheeled loaders in accordance with the
Construction Industry
Manufacturers Association (CIMA) safety manual on Wheel Tractor/Loader.
This manual
states, "Never use a bucket or blade for a work platform or personnel
carrier".
