Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of:
a) On or about 04/09/10, at 300 Dolorosa, San Antonio, TX, the employer
failed to
ensure to follow the recommended Engineering plans causing the collapse of
the ceiling exposing
the employees to the hazards of struck-by.
Among other methods, one feasible and acceptable abatement is to follow
the Professional
Engineer plans, using the material requested and completing the plans as
printed. Also the
employer could have asked the Professional Engineer if they could use a
different brand of pins
with the same lifting capacity.
