Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards. (a) On or about 3/14/11, and at times prior thereto, employees were exposed to a fall hazard of approximately 7' while accessing upper levels of the mill with the hand elevator. The hand elevator does not have any guardrail system or equally preventive measure on the hoistway entrance to prevent falling. (b) On or about 3/14/11, and at times prior thereto, employees were exposed to a fall hazard of up to approximately 40' while accessing upper levels of the mill with the hand elevator. The suspension means of the elevator car consisted of one wire rope, not two, which contained kinks. (c) On or about 3/14/11, and at times prior thereto, employees were exposed to a fall hazard of up to approximately 40' while accessing upper levels of the mill with the hand elevator. The car hoist and/or suspension components did not have the rated load capacity affixed to them. (d) On or about 3/14/11, and at times prior thereto, employees were exposed to a fall hazard of up to approximately 40' while accessing upper levels of the mill with the hand elevator. The hand elevator was not initially inspected and/or inspected on a routine basis by a qualified inspector. Among other methods, one feasible and acceptable method to correct the hazards noted are to follow the requirements in the American National Standards Institute (ANSI) American Standard Practice for the Inspection of Elevators A17.2-1960 and American Standard Safety Code for Elevators A17.1-1965, which include, among others, the following: a.Enclose all sides of the hand elevator, including the hoistway entrance, with guardrails or equally protective means. b.Schedule and complete all initial and required inspections. Abatement Note: Abatement certification and documentation is required for this item.

On or about 12/14/10, and at times prior thereto, employees were exposed to the hazards associated with falls due to the improper use of a step ladder to access the top of the outside molasses tank. Among other methods, one feasible and acceptable method to correct the hazard noted is to ensure that the ladder being used is for the purpose of its intended use. Abatement Note: Abatement certification and documentation is required for this item.
