North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a stuck by or crushed by hazard: a)Building 1002, welding area- where on or about March 28, 2011, an employee operated a Nissan 50 LPG fork lift (model MCP1F2A25LV) equipped with a roll over protection system (ROPS) without a seatbelt. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that employees wear their seat belts and comply with the American Society of Mechanical Engineers, Safety Standard for Low Lift and High Lift Trucks (forklifts), ASME B56-1-2000, paragraph 5.3.19.
