Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to drowning when the employer did not provide barriers, curbs
or other structures
to prevent a track loader from falling into the water:
a)The employer allowed an employee to operate a  CAT 973C track loader
within three
feet of the edge of flat barge CP-45 and did not ensure safeguards such as
barriers,
curbs, or other structures were provided to prevent the equipment and
operator from
falling into approximately fifty five feet of water.
One feasible and acceptable method of abating this hazard is to follow the
procedures outlined
in the U.S. Army Safety and Health Requirements Manual (EM 385-1-1) dated
15
September
2008, section 19.A.07 I. which states safeguards such as barriers, curbs,
or other structures shall
be provided to prevent front-end loaders, bulldozers, trucks, backhoes,
track hoes, and similar
operating equipment on floating equipment from falling into the water.
