Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to a struck-by hazard. On or about April 5, 2011, an employee of Diversified Transport, LLC was exposed to a struck-by hazard as the truck operated in reverse. Among other methods, some feasible and acceptable abatement methods to correct this hazard is to: 1) Ensure that the employees assigned to work as hoppers and drivers are trained in the company's policy prior to assignment, the equipment's operation manual and the American National Standard (ANSI)-Z245.1-2008, paragraph 6.2.5.4(b) and (d) which prohibits riders on the stair steps as the truck moves in reverse and ensuring that no person mounts or dismounts riding steps unless the vehicle is completely stopped. 2. Develop a safety program consistent with the requirements of ANSI-Z245.1-2008, clause 9.1 thru 9.3.4. Develope alternative safe work practices when there is only one hopper available that eliminate the hazard of being struck by the truck. 3. Implement a training program for employees consistent with the requirements of ANSI-Z245.1-2008 clause 6.1.3 and 9.1 thru 9.3.4. Enforce safety rules and ensure rules are followed (i.e. supervisory checks, job observation). Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to establish, communicate, and implement written procedures to ensure that all employees, including but not limited to drivers and hoppers, refrain from moving a truck in reverse with riders on the steps.
