Nevada Revised Statute 618.375(1):  Every employer did not furnish
employment and a place
of employment which was free from recognized hazards that were causing or
were likely to
cause death or serious physical harm to his employees:
The employer did not ensure the commercial patio heater was used in
accordance with the
owner's instructions, as follows:
a) In the warehouse, the employer had a temporary work area. A Sam's West,
Inc.
Commercial Patio Heater that was approved for outdoor use only was being
used
indoors. Employees were exposed to serious injuries in the event of a
fire.
The instruction label stated, "THIS APPLIANCE IS FOR OUTDOOR USE ONLY".
A feasible means of abatement would be to follow the manufacturer's
instruction label, or to use
a heater that is rated for indoor use.
