Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of working from a damaged aerial
basket that was not
inspected or tested by a qualified person to ensure it maintained its
structural integrity. In
addition, employees were exposed to the hazard of working  from an aerial
lift with a
structurally defected hydraulic/pneumatic cable tray.
Among other methods, one feasible and acceptable abatement method to
correct
these
hazards is to periodically inspect and test the aerial lift in accordance
with Paragraph
8.2.4 of the American National Standards Institute (ANSI) - Scaffold
Industry
Association (SIA) A92.2-2001, American National Standard Vehicle - Mounted
Elevating
and Rotating Aerial Devices.
