Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by a run away tractor:
a) Worksite, Quail Hill Farm,- The Safety Start Switch was disconnected
and not functioning
as intended on a 1990 Case International, Model #495, Serial #17332529,
equipped with a front
mounted hydraulic bucket, Model Jag 0219905; on or about 11/30/10.
ABATEMENT NOTES:
Among other feasible methods to reduce this hazard is to comply with the
precepts and warnings contained in the Case International Tractor Owners
Manual:
a. Repair or replace the Safety Start Switch, as per ref- WARNING on page
VIII-" Engine can start with the transmission in gear when neutral or

Switch is bypassed...Machine run-away can cause injury or death to
operator and
by-standers".
b. Provide instruction, training and monitor for safe methods of work for
employees who operate, clean and service equipment. As per Ref.-Safety
Rules
on page VI-"READ THIS MANUAL COMPLETELY and make sure you
understand the controls. All equipment has a limit. make sure you
understand the
speed, brakes, steering, stability and load characteristics of this
machine before
you start to operate."
Note:  In addition to abatement certification, the employer is required to
submit abatement
documentation for this item in accordance with 29 CFR 1903.19.
