Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to amputation, struck-by, caught-in, and entanglement hazards:
a) Facility Wide- On or about October19, 2010, the employer failed to
provide
dock-face
mounted dock leveling device(s) with handholds or other lifting aids.  Due
to the lack of lifting
aid being provided employees utilized long looped wire and the lifting
capabilities of a forklift
to lift each of the dock plates in docks numbers #7, #8, #9, #13, #14,
#15, #16, #17, #18, #19,
and #22.
Among others, one feasible and acceptable means of abatement to correct
this hazard is to
provide and require the use of a dock plate with a lifting means designed
to safely lift the
dock plates into place in accordance with the American National Standards
Institute
(ANSI), MH30.1-2007 For the Safety, Performance and Testing of Dock
Leveling Devices,
Section 5.2.1.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation that abatement is complete must be included with
your
certification.  This documentation may include, but is not limited to,
evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.
