Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard:
a)  Work site - 100 Polar Way - Freezer:
Employee(s) were utilizing a wooden pallet, secured to the forks of a
Crown stock picker, as
a work platform while retrieving boxed product from shelving racks, at
heights in excess of 20
feet from the ground. The pallet collapsed seriously injuring employee.
Violation occurred on or about 1/13/2011.
Among other methods, feasible and acceptable methods to correct this
hazard include, but are
not limited to the following:
1) Comply with the manufacturer's provisions outlined in the Operator
Manual which specifies
on Page 24, Platform Safety, "Work from the platform, not the pallet.
Never step on or near
the edge of the pallet.", as well as the  American National Standards
Institute, Safety Standard
for Low Lift and High Lift Trucks, ASME B56.1-2005, paragraphs 7.37
pertaining to
"Platforms: Elevating".
2) Train employees to refrain from working on pallets in accordance with
the manufacturer's
recommendations and enforce this policy.
3) Ensure all warning labels are posted as required by the manufacturer.
4) Comply with manufacturer's provisions outlined in the Operator Manual
which specifies on
Page 34, Warning Labels, "Each warning label on your truck is important.",
as well as the
American National Standards Institute, Safety Standard for Low Lift and
High
Lift Trucks,
ASME B56.1-2005, Section 4.2 pertaining to ensuring all nameplates and
caution and instruction
markings are in place and legible.
