Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential hazard of being struck-by suspended loads: a/ At the yard, frequent inspections of the magnet grapple attached to the Caterpillar 320L Tracked Material Handler and the four time orange peel grapple attached to the Liebherr 912 Tracked Material Handler were not performed. One method of abatement to correct this apparent hazard is to perform thorough frequent inspections of these mechanical lifting devices as required by ASME B30.20-2003, paragraph 20-1-3.3.
