Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
On or about March 31, 2011, during demolition work, the employer did not
provide a workplace
free from recognized hazards by allowing employees to be transported and
work from a bucket
of a Case 580 Super L backhoe. Among other methods, one feasible and
acceptable abatement
method would be to comply with the Association of Equipment Manufacturers
Safety Manual
for Operators and Mechanics of Hydraulic Excavators which states "WARNING
your
HYDRAULIC EXCAVATOR is a ONE-PERSON machine. NEVER PERMIT RIDERS." Never
use a bucket for a work platform or personnel carrier.
