North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall from elevation: a)Front elevation of building - where an employee was allowed to use a platform for elevating personnel that did not met the design requirements (slip resistant surface, missing toe plate, missing mid-rail/body belt, platform unsecured to carriage, lack of controls for elevated employee) of the manufacturer. Abatement note: The hazard could be abated by using a JLG approved personnel work platform that meets the requirements set forth in ASME B56.6-1992, 8.25-1 (a, c, e, f, h - o).
