North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck or crushed by hazards: a)job site - where employees operated a Clark Forklift (Model C500-400, Serial Number: 355-0837-5272) equipped with a roll over protection system (ROPS) without a seatbelt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require employees to use the installed seatbelt while operating the forklift. (Reference: American Society of Mechanical Engineers, Safety Standard for Low Lift and High Lift Trucks (forklifts), ASME B56-1-1993, paragraph 5.3.19)
