Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:03/21/11 Location:South Side of Job Site Condition:Employees were not protected from struck-by/crushed-by hazards posed by the swinging superstructure of an excavator. Among other methods, one feasible and acceptable method to correct this hazard is to erect a barricade around the swing radius of the superstructure of this equipment to prevent employees from being struck, or crushed by it.
