29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:     a)  1100 K St., SE, Manhole #38 - On or about 10/02/2014, the site competent person did not properly slope of bench an area above a concrete manhole structure thereby creating a 8.5 deep excavation comprised of Class B soil and having vertical walls in which workers were allowed to engaged in backfilling operations.     Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that:   a)      11th. and K Streets, SE, Manhole #38 - On or about 10/02/2014, utility workers installing a manhole structure were exposed to a cave-in hazard while occupying an excavation that was 8 ft. deep, having vertical wall and which had not been provided with protective systems by their employer.
