29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) 1100 K St., SE, Manhole #38 - On or about 10/02/2014, the site competent person did not properly slope of bench an area above a concrete manhole structure thereby creating a 8.5 deep excavation comprised of Class B soil and having vertical walls in which workers were allowed to engaged in backfilling operations. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that: a) 11th. and K Streets, SE, Manhole #38 - On or about 10/02/2014, utility workers installing a manhole structure were exposed to a cave-in hazard while occupying an excavation that was 8 ft. deep, having vertical wall and which had not been provided with protective systems by their employer. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
