Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by moving equipment (front end loaders/back hoes): Location: 769 E 95th St, Brooklyn, N.Y. On or about 05/07/11 a) Employees operating heavy equipment (front end loaders/ backhoes) in the scrap metal processing facility had obstructed views, exposing employees on foot to being struck by the moving equipment. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: To follow Caterpillar Operations and Maintenance Manual Pages 23-24 which states: "Appropriate job site organization is required in order to minimize hazards that are caused by restricted visibility. Examples of jobsite organization are: workers that direct traffic, controlled patterns of machine movement, communication between workers and operators prior to approaching the machine". In addition to this provide procedures and training for proper lane clearances so loads can be carried low to the ground therefore workers do not get struck because the load obstructed the drivers view. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
