Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of being struck by vehicular traffic:
a)  On or about 08/12/11, and at times prior there to, the flagger and
other
employees, while performing street paving work on a residential street,
were not
protected from the hazards of being struck by vehicular traffic. The
employer did
not place advance warning signs and/ or other traffic control devices to
alert
oncoming motorists.
Among others, one feasible and acceptable method to correct this hazard
would be to: 1. Follow
the requirements set forth in Part 6, chapters 6E (Flagger Control) and 6F
(Temporary Traffic
Control Devices) of the U.S. Department of Transportation (DOT) Manual on
Uniform Traffic
Control Devices (MUTCD). 2. Provide and enforce the use of advanced
warning signs to alert
traffic. 3. Provide and enforce the use of flaggers,using hand signaling
devices such as flags,
or stop/slow paddles. 4. Provide employees with appropriate training and
information on
company policies and the proper use of equipment.
