Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and/or struck by hazards: (a) Location - Warehouse: On or about 8/25/11, metal racks had structural damage to the uprights and horizontal bars, were not anchored to the floor, and held pallets that were in poor condition and were not sized to be placed safely on the racks, creating potential for the pallets to fall through. Among other methods, feasible means of abatement methods include: (1) To repair or replace all damaged metal storage racks as per manufacturer's specifications. (2) To securely anchor the foot plate of columns on racks as per manufacturer's specifications. (3) To install front-to-rear supports/load retainers on horizontal shelving as per manufacturer's specifications. (4) To develop a maintenance program designed to recognize weakness in the rack system, in order to prevent a structural collapse. (5) To develop a maintenance program to replace pallets in poor condition. (6) To follow rack manufacturer recommendations regarding proper storage and use. (7) To instruct the employees of the approved rack load capacities, enabling them to verify the maximum amount of material that could be safely stored.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while standing on elevated forks of a forklift without fall protection: (a) Location - Warehouse: On or about 8/25/11, employees were exposed to a fall hazard of up to 15 feet while working on elevated forks of a forklift to access shelving units. Among other methods, feasible and acceptable methods of abatement include: (1) To utilize a platform for elevating personnel meeting the requirements in ASME/ANSI B56.1-2000 "Safety Standard for Low Lift and High Lift Trucks for employee use". (2) To institute and enforce a company policy prohibiting the elevation of employees with a forktruck without an approved platform as per the manufacturer's specifications. (3) To provide a set of mobile safety stairs for accessing elevated shelving.

One feasible and acceptable method to correct this hazard is to ensure that operators wear seat belts at all times while operating powered industrial trucks.ial
