North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to fall from elevation:
a)site-employee working from a work platform, approximately 7 feet above
the ground,
mounted on a Sky Trak rough terrain forklift that was not securely mounted
to the
forks by a securing device (ref para 8.24.1 (h) ANSI/ITSDF B56.6-2011).
b)site-employee working from a work platform, approximately 7 feet above
the ground,
mounted on a Sky Trak rough terrain forklift, and was not provided with a
restraining
device such as guardrail or personal fall protection equipment. (ref para
8.24.1(l),
ANSI/ITSDF B56.6-2011).
c)site-employee working from a work platform, approximately 7 feet above
the ground,
that was not provided information on a data plate with the information
required in para
8.24.1(f) ANSI/ITSDF B56.6-2011)
