Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing, or likely to cause, death or serious physical harm to
employees in that employees
were exposed to struck-by hazards resulting from the release of hazardous
energy:
On or about January 11, 2012, and at other times prior thereto, at this
site, the
employer did not implement a hazardous energy control program to protect
employees from the unexpected release of hazardous energy (hydraulic)
during
equipment servicing.
Among others, one feasible means of abatement is to implement a hazardous
energy control program in accordance with the American Petroleum Institute
(API) RP 54 - 'Recommended Practice for Occupational Safety for Oil and Gas
Well Drilling and Servicing Operations" (1999, 2007) and the ANSI Z244.1 -
"Control of Hazardous Energy Lockout/Tagout and Alternative Methods" (2003,
2008).  This implementation should include steps, including, but not
limited to:
a.removal of the stored energy of high pressure hydraulic fluid prior to
adjusting and replacing faulty machine parts
b.review the program on at least an annual basis, including review of field
applications, for effectiveness and completeness
c.ensuring the performance of job safety analysis (JSA, JHA) between
site/host and visiting employers.
